The legal process, one of the most critical challenges following a disaster, is about to start for the victims of earthquakes, who have suffered material and immaterial losses and whose houses have been destroyed. This challenge is about citizens' demands from the state and contractors.

What is Disaster Victim Entitlement Application?

It reports the ownership relations of the victims with the destroyed or heavily damaged buildings and their ability to benefit from the buildings to be reconstructed or the construction credits to be given.

How and Where to Apply for Disaster Victim Entitlement?

Applications for entitlement for disaster victims are made through the e-government system. Disaster Victim Entitlement Inquiry can be made on AFAD's official website. After registering here, victims can benefit from entitlement. Thus, according to the Law on "Precautions to be Taken due to Disaster Affecting Public Life and Assistance to be Provided", an announcement is made for the application of right holders by the largest civil authority of that place in the neighborhood or village mukhtars in the place where the disaster occurs. Disaster victims must apply for entitlement within two months and submit the requested documents to the governorships or district governorships. Application inquiries can be viewed through e-government. For this purpose, the service of "inquiry of claim of entitlement in case of disaster" should be selected from the section of disaster and emergency management presidency services in the e-government. Applicants are required to submit a written request and commitment. Application and commitment context should specify the name of the disaster location, province, district, sub-district, neighborhood and village, the identity and address of the right holder, the type of disaster that has occurred or is likely to occur, the nature and subject of the request, the obligations and conditions arising from the law and the relevant regulation, the conditions and principles to be determined by the administration in terms of application method, building types, building parts and dimensions, settlement place, construction period, type of loan and duration and other issues to be complied with.

Who Can Get Disaster Victim Entitlement?

  • Those whose residences, workplaces and barns are heavily destroyed and moderately damaged, those living in the damaged secondary and third residences belonging to their parents before and on the date of the disaster,

  • Those whose houses or workplaces owned by affiliates and joint owners are damaged,

  • Families whose houses have been expropriated in order for right owners to have buildings built

Who Is Not Eligible For Entitlement?

  • Those who do not submit an application and do not undergo the indebtment process within the legal period,

  • Those who own the same type of undamaged housing, workplace, and barns belonging to themselves or their spouses,

  • Those who are tenants and guests,

  • Legal entities whose property is damaged,

  • Those who construct houses, workplaces and barns on land that does not belong to them without obtaining a construction permit,

  • Those who construct buildings without a license in places specified as objectionable in the zoning plan,

  • Those who do not have a DASK policy.
